GENERAL TERMS AND CONDITIONS OF SALE (GTCS) - 2026
Purpose
These General Terms and Conditions of Sale (GTCS) apply to all orders for services and products placed between the Client and the photographer.
Placing an order implies the Client's full acceptance of these General Terms and Conditions of Sale, unless specific terms have been agreed upon in writing between the Client and the photographer.
Definitions
For the purposes of these General Terms and Conditions of Sale, the following terms have the meanings set out below.
1. The Photographer:
Pierre Champion, photographer/videographer registered under SIRET number 908 180 268 00017 in the Oise department (60), France.
2. The Client:
Any entity—whether an individual or a legal entity—that places or has placed an order with the photographer.
3. Order:
Any order for a service or product placed by the Client with the photographer.
4. Product:
Any product offered for sale by the Seller that is derived from the photography or videography session: photographic prints, DVDs, albums, books, etc.
5. Package:
Any package selected by the Client at the time of ordering which includes, in addition to the actual shoot, certain products derived from the photography or videography session.
6. Website:
The service provider's website is: https://www.dreamstudiobypierrechampion.fr
Nature of services
The photographer offers the Client photography and/or videography coverage and sessions, held at the Client's home or any other location chosen by the Client (subject to the photographer's agreement). The photographer also offers products derived from the service: photographic prints on paper or other media, albums, and video recordings on DVD.
The photographer reserves the right to add to or modify all or part of the content of their service catalog at any time and without prior notice.
Photographic style
The Client acknowledges being familiar with the photographer's photographic style and is engaging their services with full awareness of this. The Client also acknowledges that the photographer's work is constantly evolving, that the service provided is unique and artistic, and that the delivered photos may differ from photographs taken by the photographer in the past. The Photographer commits to using their full potential and personal artistic judgment to create images that align with their personal vision of the event or photo session.
Specific Conditions
The Photographer makes every effort to adapt to the conditions of the event or session, including the location, weather, available light, time constraints, and the subjects' wishes. However, the Client acknowledges that the quality of the photos/videos depends largely on these conditions.
For event photography and/or videography, the Photographer recommends that the Client inform guests of the presence of a professional photographer and ask them to minimize their own photography and use of flash. The Photographer accepts no liability if their work is hindered by other photographers and their flashes, or if the quality of the images is affected as a result.
For coverage of a religious ceremony, the Photographer recommends that the Client inform the officials at the place of worship of the presence of a professional photographer. The Photographer accepts no liability for any access restrictions imposed by the officials at the place of worship during the ceremony that might affect the quality of the work.
If the Client wishes for specific guests to appear in the photographs and/or videos, they must communicate this request to the Photographer. Under no circumstances is the Photographer responsible for the absence or presence of specific guests in the photographs or videos.
The Photographer reminds the Client that any person present during an event or session may be photographed.
Delays
On the day of the scheduled photo session or assignment, if the Client is more than 15 minutes late relative to the agreed time, the Photographer reserves the right to deduct this time from the total duration of the session or assignment.
On the day of the scheduled photo or video session, if—despite all precautions—the Photographer is more than 15 minutes late relative to the agreed time, the Client may choose between:
- adding this time to the total duration of the session or assignment,
- receiving complimentary products derived from the session (the quantity and nature of which will be determined by the Photographer based on the length of the delay),
- a partial refund of the session or assignment fee (the amount of which will be determined by the Photographer based on the length of the delay).
For event assignments, if the Photographer is more than 15 minutes late relative to the agreed time, the Photographer agrees to offer a partial refund of at least 25% of the total price agreed upon for the selected package.
Changes to shooting duration
The Photographer reserves the right to charge for any time exceeding the schedule specified in the quote, order form, or contract.
If, during the shoot, the Client wishes to shorten the duration of the assignment or session, the Photographer shall not be held liable for these changes to the service.
Rescheduling the photo session
At the Client's request, the Photographer may agree to reschedule the photo session, provided the request is received at least one day prior to the scheduled date; this is permitted up to two times. Beyond the third rescheduling request, no further date will be offered, and any monies paid will be non-refundable.
Processing and delivery of session images
Images captured by the Photographer during the session are sorted and then edited by the Photographer.
The images are subsequently uploaded to a private, password-protected online gallery. The Client receives an email containing a link to this gallery and a unique access password. The Client may share access details with others to view the images and bears sole responsibility for such sharing. The Photographer accepts no liability for any misuse of the images by individuals with whom the Client has shared their access details.
The Client must then select—from the gallery—the photos they wish to receive as digital files and/or paper prints, in accordance with the terms of the selected package. The Client agrees to provide the list of selected photographs to the Photographer in writing. Where the package includes an album, the Client agrees to communicate their specific preferences regarding which photographs should be included in the album(s) to the Photographer.
Digital files are available for download in JPEG format via a link sent by email. Each photograph corresponds to two digital files: one high-resolution file (for printing) and one low-resolution file (for online sharing).
It is the Client's responsibility to properly safeguard the digital files provided by the Photographer. The Photographer disclaims all liability for the loss or damage of digital files delivered to the Client and reserves the right to charge a fee for any requests for duplicates.
Albums
Albums are designed by the Photographer and subsequently produced by one of their suppliers. If the Client wishes to include specific photographs in the ordered album, they must provide the list of such photographs to the Photographer at the time of the order. The Photographer will send a digital copy of the draft to the Client for approval.
The Client is entitled to two free revisions of the draft. For the purposes of these Terms and Conditions, a "revision" is defined as any set of modification requests made at the same time (e.g., replacing photographs, moving photographs, changing the layout, etc.). The Photographer reserves the right to charge for any revisions beyond the initial two.
Pricing
Prices are quoted in Euros and are exempt from VAT (VAT not applicable – Article 293B of the General Tax Code). The rates applied are those in effect on the date of the order.
Quoted rates include any applicable discounts or rebates, which will be specified on the quote and the final invoice.
The Photographer reserves the right to revise rates at any time.
Payment
The photographer accepts the following payment methods:
- via SumUp terminal (bank card)
- via bank transfer
- in cash
All orders must be paid for in Euros.
The photographer reserves the right to cancel any order or delivery in the event of a payment issue (non-payment or late payment). If the Client has failed to meet payment obligations in the past, orders for services or products may be refused.
No discount will be granted for early payment.
1. Ordering photography services
Photography service orders are confirmed upon the signing of the quote, order form, or contract.
A deposit must be paid by the Client within 15 business days of the order date and, in any case, at least one business day prior to the scheduled shoot date. If this deadline is not met, the photographer cannot guarantee the booking for the scheduled date and reserves the right to reschedule the shoot or cancel the order. The deposit amount is determined by the photographer.
The Client agrees to pay the balance prior to the delivery of any images. In the event of non-payment, the photographer reserves the right to withhold delivery of the photographs in any format (online gallery, USB drive, prints, etc.). Payment of the balance may be made in two interest-free installments upon request.
2. Ordering products
Product orders may be placed directly via the online client gallery. Full payment is required at the time of ordering. At no point may the sums paid be considered earnest money or down payments.
Any order entails an obligation to pay and constitutes acceptance of the prices and descriptions of the products available for sale.
The photographer reserves the right to suspend order processing and delivery in the event of a refused credit card payment authorization from the online payment gateway or in the event of non-payment.
If the ordered product is unavailable, the Client will be notified by email. The order will then be cancelled, and the amount paid for the cancelled order will be refunded.
Product Delivery
Products include both those already included in the shoot or photo session package (photo gallery, digital files, paper prints, albums, gift vouchers) and additional products ordered via the client gallery or directly from the Photographer, for which the Client selects all order details.
Delivery Times
The email containing order details is generally sent to the Client within 15 business days.
The download link and prints of the selected photographs included in the package are generally delivered within 15 business days of receipt of the list of photographs selected by the Client. Albums are generally delivered within 2 to 8 weeks—depending on the specific album and the supplier chosen by the photographer—following the Client's approval of the project.
Delivery time for additional products is generally 2 to 8 weeks, depending on the product, starting from receipt of payment. Delivery times are provided for information purposes only and are not guaranteed. Consequently, any delay in the delivery of products shall under no circumstances entitle the Client to claim damages or to cancel their order.
Delivery Methods
Products may be delivered in person to the Client, by mail, or electronically if the products are digital (e.g., downloadable files or electronic gift vouchers).
The Photographer agrees to in-person delivery only by appointment arranged in advance with the Client, and provided the meeting location is within 40 km of the Photographer’s home. If in-person delivery is desired, this choice must be communicated to the Photographer when ordering products (for additional products) or when submitting the list of selected photographs (for products included in the package).
Customer Responsibilities
Products are delivered to the address specified by the Customer when placing the order. The Customer is responsible for ensuring the accuracy of this address. Any parcel returned to the Photographer due to an incorrect or incomplete delivery address will be re-shipped at the Customer’s expense. If the Customer is absent on the day of delivery, they must collect the parcel from the location indicated on the delivery notice left by the courier. The Customer must adhere to the timeframes specified on the delivery notice for collecting the parcel.
In the event of missing or damaged goods, the Customer must note any necessary reservations on the delivery slip upon receipt of the product(s). Furthermore, these reservations must be confirmed in writing within five days of delivery via registered mail with acknowledgment of receipt.
Verification of the products' condition is deemed complete once the Customer—or any person authorized by the Customer—has signed the delivery slip.
Right of Withdrawal
No right of withdrawal applies, as items ordered using a credit note are non-refundable.
Ordering a Photo Session or Assignment
The Customer has a withdrawal period of 8 business days starting from the day the order is placed—specifically, from the date the quote, order form, or contract is signed.
Any decision to withdraw made within the allotted timeframe entitles the Customer to a refund of the amount paid. Once this period has expired, the sum paid for the order is non-refundable. No refund will be issued if the service has been performed, in whole or in part, with the Client’s agreement, prior to the expiration of the withdrawal period.
Product Orders
In accordance with Article L121-20-2 of the Consumer Code, the right of withdrawal cannot be exercised for ordered products derived from photo sessions or assignments, as these are considered clearly personalized items.
Cancellation
In the event of cancellation of the service by the Client after the withdrawal period (see "Right of Withdrawal" section), sums paid will not be refunded, except in cases of force majeure or illness.
The photographer reserves the right to cancel a photography service in the event of force majeure or illness. Consequently, the Client may choose between rescheduling the date or cancelling the order with a refund of the sums paid. Cancellation of the service does not entitle the Client to damages.
Cases of force majeure are defined as any irresistible events or circumstances that are external to the parties, unforeseeable, unavoidable, beyond the parties' control, and which cannot be prevented by them despite all reasonably possible efforts.
Technical Issues and Accidents
In the event of a technical issue with photographic equipment or any accident during the service that prevents the photographer from delivering the requested work, the Client may request cancellation of the order. In this case, the full amount paid will be refunded, without giving rise to the payment of damages on any grounds whatsoever.
Intellectual Property
Any photographic work grants the Photographer—its creator—artistic, economic, and moral property rights, as defined by the Intellectual Property Code. The agreement includes, among other things, the publication or use of certain photos to promote the Photographer’s business. This includes, without limitation, publication on the Photographer’s website and social media pages; participation in exhibitions and competitions; reproduction in the Photographer’s catalogs, portfolios, press kits, business cards, and flyers; or use via any existing or future method of display. Delivery of photographs via an online gallery or on physical media does not imply the transfer of intellectual property rights regarding the delivered photographs (Art. L111-3 of the Intellectual Property Code). Delivered photographs may only be used by the Client for private and family purposes. Regarding social media and internet distribution, the Client agrees to share the photos in their original state—without altering the Photographer’s work—and to use the web-format files provided for this purpose, in order to preserve copyright attribution. The Client agrees not to use the images for commercial purposes, not to reproduce or publish the photographs for sale, and not to transfer their rights to third parties. In case of doubt regarding the permissible use of the images, the Client agrees to contact the Photographer directly to obtain written authorization. The Photographer retains moral rights over their entire body of work: any alteration to the framing of the photographs, as well as any photomontage, modification, or retouching—whether via digitization or any other process—may not be performed without the Photographer’s prior written consent.
The Pierre Champion logo must appear on any photo published online. Any comments or captions accompanying the reproduction or display of the photographs must not damage the Photographer’s image or reputation. The Client agrees to share liability with the Photographer in the event of harm caused by a third party’s misuse or misappropriation of the images without the Client’s knowledge.
Right to One’s Image
The Client and any other person appearing in the photos/videos are, by law, the inalienable owners of their own image, and the Photographer scrupulously respects this right. If the Client wishes for certain photographs—in which the Client or any other person is recognizable—not to be used across all or part of the Photographer’s communication, promotional, and exhibition materials (including publication on the Photographer’s website and social media pages, participation in exhibitions and competitions, reproduction in the Photographer’s catalogs or portfolios, press kits, business cards, and flyers, or via any existing or future display method), the Client agrees to provide a written list (via post or email) of the photographs to be excluded within 30 calendar days of the photographs being delivered. After this period, the Photographer shall consider that they have the Client’s authorization to use all images in which the Client or any other person is recognizable, and reserves the right to use said photographs on the chosen media. However, the Client and any other person appearing in the photographs may exercise their right to their image at any time by submitting a written request to the Photographer to have specific images subsequently removed from the Photographer’s communication, promotional, and exhibition materials. The photographer reserves the right to use images in which no individual is recognizable on media of their choice.
In all cases, the photographer expressly prohibits any use of the photographs that could infringe upon the privacy of the Client or any other person appearing in the photographs, as well as any dissemination on media of a pornographic, xenophobic, racist, antisemitic, violent, or unlawful nature.
Personal Data
Personal data collected by the Photographer in the course of fulfilling the order placed by the Client is kept strictly confidential and is intended for the Photographer’s exclusive use. It may not be transferred to third parties. The data is processed and stored within the Photographer’s own computer systems or by their technology providers (data storage and processing, bulk email services, online payment gateways).
In accordance with the Data Protection Act No. 78-17 of January 6, 1978, regarding data processing, files, and individual liberties, the Client has the right to inquire about, access, modify, rectify, and delete their personal data.
To learn more about this subject, the Client is invited to read the page on this site dedicated to privacy: Privacy Policy.
Governing Law
Any dispute relating to the interpretation and performance of these General Terms and Conditions of Sale is subject to French law.
Before taking legal action, the parties agree to seek an amicable solution to their issue or to submit their dispute to the mediator designated by the representative bodies for professional photographers.
